In the near future, I will be introducing legislation to amend The Administrative Code of 1929 to ensure Pennsylvania remains in compliance with updated federal requirements under IRS Publication 1075. 
 
Currently, state law requires agencies to conduct enhanced criminal background checks, including federal fingerprinting, every 10 years for employees who have access to Federal Tax Information (FTI). The IRS has since revised its standards to require these checks every 5 years. 
 
Updating state law is critical to maintaining uninterrupted access to FTI for more than 10,000 Commonwealth employees across multiple agencies. Without this change, Pennsylvania risks losing access to federal tax information, which would severely hinder our agencies such as the Department of Revenue, Department of Human Services, Department of Labor and Industry, the Office of Administration, and the Office of State Inspector general from carrying out their job duties involving revenue collections and enforcing child support, unemployment and welfare fraud programs.  
 
This legislation is straightforward: it aligns Pennsylvania law with federal standards, ensures continued compliance, and protects vital state operations that depend on access to FTI.
