Colleagues, we soon plan to introduce legislation addressing the growing need for transparency in the use of generative artificial intelligence (AI). AI-generated content is becoming more prevalent in our daily lives, so it is essential that we have the ability to understand when digital content has been created or altered by AI. Our legislation will ensure that Pennsylvanians are informed and equipped with the necessary tools to verify the authenticity of digital content as AI becomes increasingly sophisticated.
 
This legislation focuses on digital content provenance, which is information embedded in or attached to digital content that helps verify its origin and authenticity. This data may include the name of the AI system that created the content, the time and date it was generated, and a unique identifier. Provenance information can be visible to users or embedded in a way that is not immediately apparent but can be detected using appropriate tools. Including this information in AI-generated content helps prevent the spread of misinformation, protects intellectual property, and supports public trust in digital media.
 
Specifically, our bill will require generative artificial intelligence providers to:
  • Provide users with a free, easy-to-use tool which will allow them to check if content was created or altered by AI and view basic provenance information about its origin.
  • Give users the option to add a visible disclosure identifying their content as AI-generated.
  • Automatically include detectable metadata in AI-generated content that provides a record of when and how it was created or altered.
 
As artificial intelligence continues to evolve, it is important that Pennsylvania takes proactive steps to ensure it is used responsibly. This legislation provides a balanced framework that supports public trust while protecting innovation.
