This bill amends Title 42 of the Pennsylvania Consolidated Statutes to introduce new provisions regarding sentencing for hate-based intimidation and the submission of community impact statements. It establishes that individuals convicted of hate-based intimidation may be required to complete at least eight hours of educational instruction or community service as a condition of probation or parole, specifically aimed at benefiting the community against which the bias was shown. The bill emphasizes that any community service must not increase the risk of further violence or intimidation towards that community.

Additionally, the bill grants representatives of affected communities the right to submit community impact statements prior to sentencing for defendants convicted of hate-based intimidation. These statements can detail the harm, trauma, economic loss, and other adverse effects experienced by the community due to the crime. The court is required to consider these statements when determining the appropriate sentence. Furthermore, the bill prohibits the exclusion of individuals from trial based on their potential to provide community impact information during sentencing. The act is set to take effect in 60 days.
