Produce sold in grocery stores is exempt from sales tax. If you want to buy seeds to grow vegetables in your own home garden, unless you are a farmer, you must pay state sales tax on those seeds.

When citizens want to grow their own food at home, they should not have to pay sales tax to purchase the seeds. This legislation would establish a sales tax exemption for the sale or use of fruit seeds, vegetable seeds, or other seeds that can be grown for human consumption.

We want to ensure that residents of our Commonwealth who grow their own produce, are exempt from the additional cost of a sales tax, just as they are when purchasing these same items in a grocery store.
