The Workplace Heat Protection Standards Act aims to enhance employee safety by establishing regulations to prevent heat-related injuries and illnesses. The bill requires the Secretary of Labor and Industry to develop regulations that mandate employers to provide access to cool water, rest breaks, and training on heat-related risks. Employers must also create a heat-related injury and illness prevention plan, which should be reviewed annually and made available to employees in their preferred languages if a significant portion of the workforce speaks a language other than English. The act prohibits discrimination or retaliation against employees who report violations or refuse unsafe work conditions, allowing them to pursue legal action for adverse consequences.
Furthermore, the bill outlines penalties for noncompliance, including administrative fines for employers who fail to meet the established requirements, with escalating penalties for willful or repeated violations. It establishes the Heat Protection Enforcement Fund to collect fines and support investigations and enforcement efforts. The Secretary is also tasked with ensuring that employees accompanying inspectors during workplace inspections do not face wage reductions and that their rights under collective bargaining agreements are preserved. The act is set to take effect 60 days after its passage, aiming to improve workplace safety standards in high-heat conditions.
