The bill amends Title 58 of the Pennsylvania Consolidated Statutes regarding well permits by adding a new subsection that prohibits the drilling or alteration of oil and gas fluid injection wells for the purpose of disposal or storage. Specifically, it states that no person may inject fluids produced in association with oil and gas production, and the department is barred from issuing permits for such activities.
Additionally, the bill allows individuals who reside or own property within five miles of a well drilled or altered in violation of this prohibition, or who operate a business within that radius, to bring legal action in a court of common pleas to enforce compliance. The court may grant various forms of relief, including actual damages, attorney fees, court costs, and equitable or injunctive relief. The act is set to take effect 60 days after its passage.
