For those with two or more prior convictions, the minimum sentence escalates to 15 years of total confinement.
The bill also outlines the conditions under which parole may be granted, stating that it cannot be awarded until the minimum term is served. It specifies that the imposition of mandatory minimum sentences must be based on facts proven beyond a reasonable doubt and provides a framework for the sentencing court to verify the offender's previous convictions. Furthermore, it grants the Commonwealth the right to appeal if a sentencing court fails to apply the mandatory minimum sentences as required. The act is set to take effect 60 days after its passage.
