The bill amends Title 42 of the Pennsylvania Consolidated Statutes to establish mandatory minimum sentences for individuals convicted of offenses related to the possession, use, manufacture, control, sale, or transfer of firearms, specifically under 18 Pa.C.S. ยง 6105. It introduces a new section, 9720.9, which mandates that individuals convicted under this statute face a minimum imprisonment term of 11 months if their conviction stems from a prior felony conviction under the same law. Additionally, if the offense is graded as a felony and the individual has a previous conviction under the same statute, the minimum sentence increases to five years. For those with two or more prior violations, the minimum sentence escalates to 15 years of total confinement.
The bill also outlines the conditions under which these mandatory minimum sentences apply, including provisions for parole eligibility and the requirement for the sentencing court to have a complete record of the offender's previous convictions. It allows for the Commonwealth to appeal if a sentencing court fails to apply these mandatory minimums appropriately. The act is set to take effect 60 days after its passage.
