I will soon be introducing legislation to establish transparency and fairness standards for the use of personalized algorithmic pricing in the Commonwealth.
As companies increasingly use data-driven algorithms to tailor prices based on individual consumer profiles, Pennsylvanians deserve clarity and protection. Without appropriate safeguards, these pricing systems can result in unfair discrimination, particularly when based on protected characteristics such as race, gender, age, disability, or sexual orientation.
This legislation will:
- Require clear disclosure when prices are set using personalized algorithms and consumer-specific data.
- Prohibit the use of protected class data in ways that lead to unequal or discriminatory pricing.
- Empower the Attorney General and the Bureau of Consumer Protection to investigate violations and pursue enforcement.
- Allow consumers harmed by such practices to file complaints directly with the Bureau.
- Provide exemptions for insurers and financial institutions already subject to regulatory oversight.
As technology advances, Pennsylvania must act to ensure fairness in the digital marketplace. This bill promotes accountability and empowers consumers.
