This bill amends Titles 18 and 75 of the Pennsylvania Consolidated Statutes to enhance the legal framework surrounding human trafficking. It introduces new definitions, including "Authorized entity," "Coordinator," "Governmental entity," and "Victim determination statement," which clarify the roles and responsibilities of various organizations and individuals involved in identifying and assisting victims of human trafficking. A new section, 3027, is added to allow courts, governmental entities, or authorized entities to issue victim determination statements, which document an individual's status as a victim of human trafficking. This statement must be filed with the Office of Victim Advocate and includes details about the duration of victimization and any related offenses.
Additionally, the bill establishes a process for victims of human trafficking to restore their operating privileges if they have had their driving rights suspended or revoked due to their victim status. Under the new section 1559, individuals with a victim determination statement can petition for relief from such suspensions, and the Department of Transportation is required to restore driving privileges if it is determined that the individual does not pose a risk to traffic safety. The bill also mandates cooperation from courts and agencies in providing necessary documentation to support these determinations. The act is set to take effect in 60 days.
