When purchasing a firearm, individuals are required to undergo a background check through the Pennsylvania Instant Check System (PICS), which is utilized by the Pennsylvania State Police. While this system is vital for ensuring those who should not own firearms cannot purchase them, occasionally denials are issued by PICS that the individual attempting to purchase a firearm believes to be mistaken. Denials can occur in the PICS system due to incomplete records, prior convictions that should no longer prevent an individual from owning a firearm, and even simple mistakes. In these cases, it can be difficult to access the reasoning behind the denial.
 
To remedy this issue, we plan to introduce legislation to allow individuals or their attorneys to subpoena evidence that is relevant to the denial. This would allow individuals to review the basis behind the denial and to determine whether or not the reasoning for the denial is accurate.
Law-abiding individuals who have been issued a denial by PICS deserve a proper chance at rectifying any mistakes that prevent them from purchasing a firearm.
