This bill amends the Controlled Substance, Drug, Device and Cosmetic Act to introduce specific prohibitions and penalties related to the preparation, manufacture, sale, or distribution of kratom products to minors. It establishes criteria under which such actions are considered illegal, including the mixing of kratom with harmful non-kratom substances, the presence of poisonous ingredients, excessive levels of residual solvents, high concentrations of 7-hydroxymitragynine, the inclusion of synthetic alkaloids, and inadequate labeling for safe use. Retailers are provided a defense against criminal liability if they can demonstrate good faith reliance on processors regarding compliance with these regulations.

Additionally, the bill outlines penalties for violations, categorizing them based on whether the violator is a processor or not. A processor who knowingly or intentionally violates the new provisions is guilty of a first-degree misdemeanor, while others face a second-degree misdemeanor. The act is set to take effect 60 days after its passage.
