This bill amends the Controlled Substance, Drug, Device and Cosmetic Act to introduce specific prohibitions and penalties related to the preparation, manufacture, sale, or distribution of kratom products to minors. It establishes criteria under which such actions would be considered illegal, including the mixing of kratom with harmful non-kratom substances, the presence of poisonous ingredients, excessive levels of residual solvents, and inadequate labeling for safe use. Additionally, it defines key terms such as "kratom product," "kratom extract," "processor," and "retailer" to clarify the scope of the law.

The bill also outlines penalties for violations, categorizing them based on whether the offender is a processor or not, with processors facing a misdemeanor of the first degree for knowingly violating the provisions, while non-processors would face a misdemeanor of the second degree. Furthermore, it provides a defense for retailers who can demonstrate good faith reliance on processors regarding compliance with the law. The act is set to take effect 60 days after its passage.
