The bill amends Title 38 of the Pennsylvania Consolidated Statutes to establish Election Day as a legal holiday. It introduces a new part, PART III, which includes Chapter 21 specifically dedicated to Election Day. The chapter defines key terms such as "Election Day," "general election," "municipal election," and "primary election," and outlines the responsibilities of public and private employers regarding this holiday. Public employers are mandated to observe Election Day as a legal holiday, while school districts and counties have the option to do so.
Additionally, the bill requires private employers to provide their employees with at least two hours of unpaid leave to vote on Election Day. If a private employer fails to comply, they will incur a civil penalty of no less than $1,000, payable to the county board of elections. The Department of State is tasked with enforcing these provisions and may create necessary regulations for implementation. The act is set to take effect 60 days after its passage.
