The proposed bill amends Title 18 of the Pennsylvania Consolidated Statutes by introducing a new section that prohibits the publication or dissemination of booking photographs for commercial use. Under this new provision, individuals engaged in such activities will be guilty of a second-degree misdemeanor if they solicit or accept payment to alter or refrain from publishing these photographs. Each instance of payment or consideration solicited or accepted in violation of this law will be treated as a separate offense.
Additionally, the bill establishes that any conduct violating this section will also be considered a breach of the Unfair Trade Practices and Consumer Protection Law. It clarifies the venue for prosecution, stating that offenses can be prosecuted where the solicitation or acceptance of payment occurred, and it allows for convictions if either the victim or the offender is located within Pennsylvania. The bill also defines "booking photograph" as an image generated by law enforcement for identification purposes. The act is set to take effect 60 days after its passage.
