The proposed bill amends Title 18 of the Pennsylvania Consolidated Statutes by adding a new section, 6143, which establishes requirements for the safe storage of firearms when not in use. Under this new provision, firearm owners are mandated to secure their firearms using specific methods, such as employing a locking device that prevents discharge, utilizing a built-in locking mechanism, or storing the firearm in a securely locked box or container. Exceptions to these requirements are provided for individuals carrying a firearm on their person or within close proximity, allowing for immediate access.
The bill also outlines penalties for violations of the safe storage requirements, categorizing offenses based on the number of violations and the consequences of unsecured firearms. A first offense is classified as a summary offense with no imprisonment, while subsequent offenses escalate to misdemeanors or felonies, particularly if the unsecured firearm is used in a crime or results in injury or death. Additionally, the bill includes defenses against prosecution, such as proving the firearm was secured properly or was obtained through unlawful entry. The act is set to take effect 60 days after its passage.
