The proposed bill amends Title 18 of the Pennsylvania Consolidated Statutes to introduce a new section, 6143, which mandates safe storage of firearms for individuals residing with someone who is prohibited from possessing a firearm. Under this new provision, firearm owners must secure their weapons using specific methods, such as a locking device that prevents discharge, a built-in locking mechanism, or storing the firearm in a locked box or container. There are exceptions for individuals carrying a firearm on their body or in close proximity, allowing for immediate access.

The bill also establishes penalties for violations of the safe storage requirements, categorizing offenses based on the number of violations and the circumstances surrounding them. A first offense is classified as a summary offense, while subsequent offenses escalate to misdemeanors or felonies, particularly if a prohibited person gains access to the firearm and uses it in a crime or causes injury or death. Defenses against prosecution are outlined, including proper securing of the firearm, unlawful entry, and incidents related to target shooting or official duties of law enforcement or military personnel. The act is set to take effect 60 days after its passage.
