The bill amends the Human Services Code of Pennsylvania to introduce a new section, Section 443.16, which provides for payments for extraordinary personal care services. It mandates that the Department of Human Services seek a waiver from the Centers for Medicare and Medicaid Services to allow payments for such services when provided by a legally responsible relative to a Medical Assistance recipient, contingent upon federal approval.
Additionally, the bill requires the Legislative Budget and Finance Committee to conduct a study on the costs associated with the implementation of any waiver granted under this new provision within two years of its approval. A report detailing the findings of this study must be submitted to various legislative leaders, including the Governor and committee chairpersons, within three years of the waiver's implementation. The act is set to take effect 180 days after its passage.
