The bill amends Title 35 of the Pennsylvania Consolidated Statutes to establish protections against PFAS (per- and polyfluoroalkyl substances) chemicals in firefighting foam. It prohibits manufacturers from producing or selling class B firefighting foam containing intentionally added PFAS chemicals starting July 1, 2026, and restricts the use of such foam by firefighting entities beginning January 1, 2027. Exceptions are made for cases where federal law mandates the inclusion of PFAS in firefighting foam, and provisions are included for the management of existing stocks of PFAS-containing foam. The bill also outlines the duties of the commissioner, including assisting firefighting entities in transitioning to PFAS-free foam and developing plans for the responsible disposal of existing stocks.

Additionally, the bill empowers the Office of the Attorney General to enforce these provisions and establishes civil penalties for violations, with fines of up to $5,000 for first offenses and $10,000 for subsequent offenses. Funds collected from these penalties will be directed to the Online Training Educator and Training Reimbursement Account. The bill also defines key terms related to firefighting entities, manufacturers, and exempt facilities, ensuring clarity in its implementation. The act is set to take effect immediately upon passage.
