The bill amends Title 8 of the Pennsylvania Consolidated Statutes regarding the process for filling vacancies in elective borough offices. It introduces a new structure for the vacancy board, which must be convened within 15 days if the borough council fails to fill a vacancy within 30 days. The council can also choose to convene the vacancy board within that initial 30-day period if it is unable to fill the vacancy and provides justification in a public meeting. The vacancy board will consist of council members, excluding the mayor, and one registered elector appointed as chair, who cannot vote for themselves to fill the vacancy.
Additionally, the bill modifies the process for petitioning the court of common pleas to fill vacancies. If the vacancy board does not fill the position within 15 days, or if the chairperson's position is vacant and the remaining members cannot fill it sooner, the court will be petitioned to appoint a registered elector to hold the office until the next municipal election. The bill also clarifies that if more than a majority of council offices are vacant, the court will fill those vacancies upon a petition signed by at least 15 registered electors or the remaining council members. The act will take effect 60 days after its passage.
