In the near future I will be introducing legislation to allow a law enforcement officer to file an appeal with a court of competent jurisdiction to challenge their separation record.

Under current law, a law enforcement officer may request a correction or removal of a portion of their separation record if they believe it is incorrect. It is then at the discretion of the law enforcement agency to either allow or disallow the correction of the record. 

Currently, there is no outside entity to provide a review of the determination of the law enforcement agency, even if the officer disagrees with the determination. My bill will allow the officer to appeal to a court of competent jurisdiction to review the determination made by the law enforcement agency regarding the officer's separation record. This additional review will help to create a fair process for an officer who is challenging their record.
