The proposed bill amends the Pharmacy Act of September 27, 1961, by adding a new section, Section 9.6, which mandates price disclosure for prescription medications. Under this section, pharmacies are required to disclose the current retail price of both brand-name and generically equivalent drugs upon consumer request. Additionally, pharmacies must inform consumers of their cost-sharing amounts for these medications and provide information on how to apply for subsidized health coverage through the Commonwealth's health insurance exchange. A disclaimer will also be included, advising consumers that their healthcare choices should consider their overall health and financial circumstances.
Pharmacies must maintain a record of this section and any related regulations, and they are required to post a notice informing consumers of their right to request this information. Non-compliance with these requirements will result in a summary offense, with fines up to $500. The bill also outlines definitions for key terms used in the section, such as "cost-sharing amount" and "pharmacy retail price." The provisions of this act will take effect immediately for certain sections, while the remainder will be effective one year after enactment.
