The Carbon Monoxide Alarm Standards in Lodging Establishments Act establishes requirements for the installation and maintenance of carbon monoxide alarms in lodging establishments that utilize fossil fuel-burning appliances or have attached garages. Under this act, such establishments must have operational, centrally located, and approved carbon monoxide alarms installed within 18 months of the act's effective date. The act defines key terms, including "lodging establishment," which encompasses hotels, motels, inns, and similar facilities, while explicitly excluding college or university student residence halls. Additionally, it outlines the responsibilities of lodging establishment owners for the maintenance, repair, or replacement of these alarms.
The act also includes enforcement provisions, stipulating that willful failure to comply with the installation or maintenance requirements of the carbon monoxide alarms constitutes a summary offense, punishable by a fine of up to $50. The act does not modify the authority of the Department of Labor and Industry under the Pennsylvania Construction Code Act, ensuring that existing regulatory frameworks remain intact. The act is set to take effect immediately upon passage.
