This bill amends the Controlled Substance, Drug, Device and Cosmetic Act of April 14, 1972, by introducing a new section that establishes reporting requirements for interactive computer service providers. Under the new Section 13.10, these providers are mandated to report to the Pennsylvania State Police when they have actual knowledge of an individual engaging in or planning to engage in the unlawful manufacture, delivery, or possession with intent to manufacture or deliver a controlled substance. The report must include various identifying information about the individual, such as their contact details, electronic communication data, and any relevant content related to the unlawful activity.

Additionally, the bill imposes penalties for non-compliance, with fines reaching up to $150,000 for a first offense and $300,000 for subsequent offenses. However, it clarifies that interactive computer service providers are not required to monitor users or their communications proactively. The bill aims to enhance law enforcement's ability to address drug-related offenses facilitated through digital platforms while balancing the responsibilities of service providers. The act will take effect 60 days after its passage.
