The proposed bill, known as the Earned Compliance Credit Act, amends Title 61 of the Pennsylvania Consolidated Statutes by adding a new subchapter focused on earned compliance credits for individuals on probation or parole. This subchapter outlines definitions for key terms such as "Agency," "Case plan," "Compliance credit," and "Supervised individual." It establishes a system where supervised individuals can earn compliance credits—15 days for each month they meet specific requirements, including fulfilling their case plan, avoiding new arrests, and making scheduled payments for restitution and fines.
Additionally, the bill mandates that agencies award these credits and allows for the placement of individuals in nonactive supervision status based on earned credits. It also includes provisions for the forfeiture of credits in cases of supervision violations, with a structured approach to restoring forfeited credits based on compliance. Importantly, individuals who are unable to pay court costs, restitution, or fines due to financial hardship will not be barred from earning compliance credits, provided they meet other eligibility criteria. The act is set to take effect 60 days after its passage.
