AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, IN GENERAL PROVISIONS, FURTHER PROVIDING FOR <--
3 DEFINITIONS; in licensing of drivers, further providing for
4 learners' permits, for application for driver's license or
5 learner's permit, for application for driver's license or
6 learner's permit by minor and for issuance and content of
7 driver's license; and, in fees, further providing for
8 driver's license and learner's permit.
9 The General Assembly of the Commonwealth of Pennsylvania
10 hereby enacts as follows:
11 Section 1. Section 1505(g) of Title 75 of the Pennsylvania <--
12 Consolidated Statutes is amended and subsection (e) is amended
13 by adding a paragraph to read:
14 SECTION 1. SECTION 102 OF TITLE 75 OF THE PENNSYLVANIA <--
15 CONSOLIDATED STATUTES IS AMENDED BY ADDING A DEFINITION TO READ:
16 § 102. DEFINITIONS.
17 SUBJECT TO ADDITIONAL DEFINITIONS CONTAINED IN SUBSEQUENT
18 PROVISIONS OF THIS TITLE WHICH ARE APPLICABLE TO SPECIFIC
19 PROVISIONS OF THIS TITLE, THE FOLLOWING WORDS AND PHRASES WHEN
20 USED IN THIS TITLE SHALL HAVE, UNLESS THE CONTEXT CLEARLY
1 INDICATES OTHERWISE, THE MEANINGS GIVEN TO THEM IN THIS SECTION:

3 "MINOR EXPERIENCING HOMELESSNESS." AN INDIVIDUAL UNDER 18
4 YEARS OF AGE WHO MEETS THE DEFINITION OF "HOMELESS CHILDREN AND
5 YOUTHS" UNDER 42 U.S.C. § 11434A (RELATING TO DEFINITIONS).

7 SECTION 2. SECTION 1505(G) OF TITLE 75 IS AMENDED AND
8 SUBSECTION (E) IS AMENDED BY ADDING A PARAGRAPH TO READ:
9 § 1505. Learners' permits.

11 (e) Authorization to test for driver's license and junior
12 driver's license.--A person with a learner's permit is
13 authorized to take the examination for a regular or junior
14 driver's license for the class of vehicle for which a permit is
15 held. Before a person under the age of 18 years may take the
16 examination for a junior driver's license, including a Class M
17 license to operate a motorcycle, the minor must:

19 (2.1) Present the certification form required by <--
20 paragraph (2) signed by a teacher, social worker or children
21 and youth caseworker if that person meets the definition of
22 "homeless children and youths" under 42 U.S.C. Ch. 119
23 (relating to homeless assistance).
24 (2.1) IF THE INDIVIDUAL IS A MINOR EXPERIENCING <--
25 HOMELESSNESS, THE INDIVIDUAL MAY PRESENT THE CERTIFICATION
26 FORM REQUIRED BY PARAGRAPH (2) SIGNED BY A TEACHER, SOCIAL
27 WORKER OR CHILDREN AND YOUTH CASEWORKER OF THE MINOR
28 EXPERIENCING HOMELESSNESS.

30 (g) Liability.--Submission of a certification under

1 subsection (e)(2) shall not subject [the parent, guardian,
2 person in loco parentis or spouse of a married minor to any
3 liability based upon the certification.] any of the following to
4 any liability based on the certification:
5 (1) the parent, guardian, person in loco parentis or
6 spouse of a married minor; or
7 (2) teacher, social worker or children and youth
8 caseworker of any minor who meets the definition of "homeless <--
9 children and youths" under 42 U.S.C. Ch. 119 (relating to
10 homeless assistance). A MINOR EXPERIENCING HOMELESSNESS. <--

12 Section 2 3. Section 1506 of Title 75 is amended by adding a <--
13 subsection to read:
14 § 1506. Application for driver's license or learner's permit.

16 (c) Homeless children and youth.--A person who meets the <--
17 definition of "homeless children and youths" under 42 U.S.C. Ch.
18 119 (relating to homeless assistance) MINOR EXPERIENCING <--
19 HOMELESSNESS shall be permitted to use a temporary address,
20 including the address of a school, foster home or shelter, for
21 any application under this section.
22 Section 3 4. Section 1507(a) of Title 75 is amended to read: <--
23 § 1507. Application for driver's license or learner's permit by
24 minor.
25 (a) Signature of parent or guardian.--The application of any
26 person under the age of 18 years for a learner's permit or
27 driver's license shall also be signed by the father, mother,
28 guardian or person in loco parentis which signature shall be
29 verified before a person authorized to administer oaths or
30 before an authorized department employee. In addition to the

1 requirements of this subsection, the signature of a teacher,
2 social worker or children and youth caseworker shall be accepted <--
3 for a person who meets the definition of "homeless children and
4 youths" under 42 U.S.C. Ch. 119 (relating to homeless
5 assistance). OF A MINOR EXPERIENCING HOMELESSNESS SHALL BE <--
6 ACCEPTED.

8 Section 4 5. Sections 1510 and 1951 of Title 75 are amended <--
9 by adding subsections to read:
10 § 1510. Issuance and content of driver's license.

12 (k) Waiver of fee.--A person who meets the definition of <--
13 "homeless children and youths" under 42 U.S.C. Ch. 119 (relating
14 to homeless assistance) MINOR EXPERIENCING HOMELESSNESS shall <--
15 not be required to pay a fee to obtain a AN INITIAL driver's <--
16 license or AN INITIAL identification card. <--
17 § 1951. Driver's license and learner's permit.
18 * * *
19 (e) Waiver of fee.--A person who meets the definition of <--
20 "homeless children and youths" under 42 U.S.C. Ch. 119 (relating
21 to homeless assistance) MINOR EXPERIENCING HOMELESSNESS shall <--
22 not be required to pay a fee to obtain a AN INITIAL driver's <--
23 license or AN INITIAL identification card. <--
24 Section 5 6. This act shall take effect in 60 days 19 <--
25 MONTHS.
