This bill amends the Pennsylvania Pesticide Control Act of 1973, specifically Section 37, to modify the delegation of duties and the limitations on local laws and regulations regarding pesticides. The amendment replaces the term "Exclusion" with "Limitation" to clarify the scope of local authority. It establishes that while the act occupies the entire field of pesticide regulation, municipalities can create restricted application districts in areas with a population density of at least 300 persons per square mile. These districts can limit or prohibit the application of certain pesticides by commercial applicators on private property, but do not extend to aerial applications, public property, agricultural property, or applications by public applicators.
Additionally, the bill mandates that the Department of Community and Economic Development prepare a sample advisory ordinance within 120 days of the effective date to assist municipalities in exercising their new authority. This change aims to balance state regulation with local concerns regarding pesticide use in densely populated areas while maintaining the overarching authority of state law. The act is set to take effect 60 days after its passage.
