A new subsection (h.1) is added to Section 4706, which outlines a revised State implementation plan that mandates the Department of Environmental Protection to initiate the removal of certain counties from the enhanced vehicle emission inspection and maintenance program within 60 days of the bill's effective date. The counties specified for removal are categorized by class and population based on the most recent Federal decennial census.
Additionally, the bill requires that the revised State implementation plan be completed and submitted to the United States Environmental Protection Agency by January 1, 2026. This plan must demonstrate that the listed counties can maintain relevant air quality standards without the emissions reductions from the vehicle inspection program. The Department of Environmental Protection is also tasked with ensuring compliance with Federal law during this process and must notify various legislative committees of the submission. Upon approval of the plan by the EPA, the Secretary of Environmental Protection is required to publish a notice of approval in the Pennsylvania Bulletin. The act is set to take effect 60 days after its passage.
