This bill amends the Pharmacy Act of September 27, 1961, to include new definitions and provisions regarding the dispensing of naloxone and similar treatments by emergency medical services (EMS) providers. It introduces two key definitions: "EMS provider," which refers to emergency medical services personnel as defined in Pennsylvania law, and "dose package," which is described as an individually sealed package containing naloxone or another treatment regimen for reversing an opioid-related overdose.
Additionally, the bill modifies existing unlawful acts related to pharmacy practice by allowing EMS providers to dispense dose packages under specific conditions. These conditions include having a standing order from the Secretary of Health that permits public purchase of naloxone without a prescription, the EMS provider's assessment of the appropriateness of dispensing the dose package, and the requirement for proper documentation of the dispensing. The bill also clarifies that EMS providers are not obligated to stock or dispense these packages and will not incur liability for choosing not to do so. The act is set to take effect 60 days after its passage.
