The bill also outlines specific conditions under which EMS providers may dispense these dose packages, including the necessity of a standing order from the Secretary of Health and the discretion of the EMS provider to determine the appropriateness of dispensing to individuals in need.
Additionally, the bill modifies existing unlawful acts related to pharmacy practice by allowing EMS providers to dispense dose packages under certain conditions while maintaining that it is unlawful for unlicensed individuals to engage in pharmacy practices. The new provisions clarify that EMS providers are not obligated to stock or dispense dose packages and will not incur liability for choosing not to do so. The act is set to take effect 60 days after its passage.
