AN ACT
1 Amending Title 3 (Agriculture) of the Pennsylvania Consolidated
2 Statutes, in food protection, providing for food allergy
3 awareness program.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 5705 of Title 3 of the Pennsylvania
7 Consolidated Statutes is amended to read:
8 ยง 5705. [(Reserved).] Food allergy awareness program.
9 (a) Establishment.--The Department of Health shall establish
10 a food allergy awareness program. The food allergy awareness
11 program shall require a public eating or drinking place to
12 comply with all of the following:
13 (1) Designate a manager who is knowledgeable regarding
14 issues concerning food allergies and food preparation.
15 (2) Require each food employee to review the materials
16 provided under subsection (b) on food allergy issues.
17 (b) Materials.--The Department of Health shall prepare and
18 provide written and video materials on food allergy issues to a
1 public eating or drinking place for review by each food employee
2 as required under subsection (a)(2).
3 (c) Licensure requirements.--Each licensor, in collaboration
4 with the Department of Health, shall require a minimum knowledge
5 of food allergy issues as a condition for licensure under
6 section 5703 (relating to license required).
7 Section 2. This act shall take effect in 60 days.
