Produce sold in grocery stores is exempt from sales tax. If you want to buy seeds and starter plants for a home garden, unless you are a farmer, you must pay state sales tax on vegetable seeds, vegetable plants, fruit plants and fruit trees.

When citizens want to grow their own food at home, they should not have to pay sales tax to purchase the seeds and plants in order to do so.

This legislation would establish a sales tax exemption for the sale or use of fruit seeds, vegetable seeds, fruit plants, vegetable plants, fruit trees, or other plants or trees that can be grown for human consumption.

We want to ensure that residents of our Commonwealth who grow their own fruits and vegetables, are exempt from the additional cost of a sales tax, just as they are when purchasing these same items in a grocery store.
