Additionally, the agency must include a detailed description of any data supporting the applicability of this guidance, including an explanation of how the data was obtained and justification for its acceptability. The burden of proof lies with the agency to demonstrate that the data is acceptable.
This amendment aims to enhance transparency and accountability in the regulatory process by ensuring that any external guidance used in regulations is thoroughly justified and relevant to Pennsylvania. The act will take effect 60 days after its passage.
