Pennsylvania ranks among the worst states in the country for radon levels, which exposes many homes and people in this Commonwealth to harmful radioactive particles. People who are worried about radon levels on their property may seek testing information from the Department of Environmental Protection if the data is available.
Current law contains reasonable protections for the confidentiality of this data. However, if previous property owners had any radon data collected while they owned the property, and would now like to access this information, the Department of Environmental Protection is not legally allowed to disclose this data.
Soon, I plan on introducing legislation that would amend the Radon Certification Act to allow previous owners of a property to obtain radon data collected during the time in which they owned the property.
