In the near future, I will reintroduce legislation to exclude future non-public employees of the Pennsylvania School Boards Association (PSBA) from public pension benefits.  It was SB 1238 from the prior Session.
 
PSBA has been a member of the Public School Employees' Retirement System (PSERS) since 1939. Its inclusion resulted from a Pennsylvania Attorney General’s opinion intended to impact one person. This legislation corrects this error. 
 
If you are not a public employee, you should not be in Pennsylvania’s public employee pension system.  PSBA has also stated that its role is not that of a public or governmental agency and agrees that employees hired after this legislation takes effect should not participate in a public employee pension system.  
 
This legislation will build upon the work accomplished in Act 120 of 2010. While only a small step toward addressing the obligations of the public retirement systems, I believe it is an important one.
