The term “mass killing” describes events in which four or more people died, not including the perpetrators. Although mass killings are rare, they contribute to thousands of deaths each year. As of December 3, 2024, the United States has witnessed 27 mass killings resulting in 2,543 deaths. It is often argued that the loss of these lives could possible be prevented since two-thirds of mass shooters have a history of violence towards others and frequently share their plans ahead of time.  
 
On the other hand, suicides by firearms make up the majority of gun deaths. According to the Centers for Disease Control and Prevention, about 27,000 of 50,000 suicides were carried out by guns in 2022 resulting in the highest level since officials began tracking it more than 50 years ago. What if there was a crisis intervention tool that family members could utilize to possibly prevent a loved one from taking their own life and in some cases get treatment for their mental health issues?  
 
Twenty-one states and the District of Columbia have enacted some sort of Extreme Risk Protection Order (ERPO), also known as “Red Flag Laws.” Introduced for several sessions now, my legislation would empower families and police officers to petition a court to temporarily remove firearms from someone who is a threat to themselves or others. The bill is modeled after domestic and sexual assault PFAs (which all 50 states have) and would require the person who is subject to a ERPO to surrender their guns to the police within 48 hours after a hearing takes place. An individual would also be temporarily banned from buying, selling or possessing firearms during the suspension for up to one year. In issuing an ERPO, the judge could also refer the person in crisis for evaluation to ensure that they get the help they need.  During the suspension period, the subject would have every right to petition a judge to rescind the suspension.
