I am reintroducing legislation to strengthen the manifest injustice provisions of Title 23, Section 3702, known as the Alimony Pendente Lite (APL) law. I was contacted by a constituent who was forced to pay APL to her former spouse and abuser during divorce proceedings. In order to correct this issue, I am proposing to add language requiring a judge to consider if a party has a history of harassment or protection from abuse orders against the other party. By requiring judges to look at these issues without an outright mandate, judges can consider more factors, maintain discretion, and prevent unintended consequences, while weighing manifest injustice concerns.

Last session the APL Reform bill was Senate Bill 1329. SB 1329 was cosponsored by Senators Fontana, Pennycuick, Collett, Brewster, and Cappelletti.
