AN ACT
1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2 act relating to the public school system, including certain
3 provisions applicable as well to private and parochial
4 schools; amending, revising, consolidating and changing the
5 laws relating thereto," in preliminary provisions,
6 prohibiting biometric identifying technology.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. The act of March 10, 1949 (P.L.30, No.14), known
10 as the Public School Code of 1949, is amended by adding a
11 section to read:
12 Section 134. Prohibiting Biometric Identifying Technology.--
13 (a) A school entity may not purchase or utilize biometric
14 identifying technology for any purpose, including school
15 security.
16 (b) As used in this section, the following words and phrases
17 shall have the meanings given to them in this subsection unless
18 the context clearly indicates otherwise:
19 "Biometric identifying technology." A tool using an
20 automated or semi-automated process that assists in verifying an
1 individual's identity based on the individual's biometric
2 information.
3 "Biometric information." An electronic measurement or
4 evaluation of a physical or behavioral characteristic that can
5 be used for automated recognition of an individual, including
6 facial characteristics, fingerprint characteristics, hand
7 characteristics, eye characteristics, vocal characteristics and
8 any other characteristic that can be used to identify an
9 individual. The term includes facial geometry, fingerprints,
10 handprints, retina and iris patterns, DNA sequencing, voice and
11 gait.
12 "School entity." A school district, intermediate unit, area
13 career and technical school, charter school, cyber charter
14 school or regional charter school.
15 Section 2. This act shall take effect in 30 days.
