A RESOLUTION
1 Urging the Congress of the United States, along with the
2 National Collegiate Athletic Association, to pursue
3 legislative remedies that would help provide uniformity of
4 the name, image and likeness policy across the states.
5 WHEREAS, On June 21, 2021, the United States Supreme Court
6 unanimously ruled against the National Collegiate Athletic
7 Association (NCAA) in National Collegiate Athletic Association v
8 Alston that the NCAA could not limit education-related payments
9 to student-athletes. The NCAA then deferred to state laws on
10 name, image and likeness (NIL) and, in states that hadn't
11 enacted laws, the schools themselves; and
12 WHEREAS, On January 10, 2024, the NCAA Division I Council
13 adopted new NIL protections which went into effect on August 1,
14 2024. The new protections were designed to protect student-
15 athletes by promoting the sharing and centralization of
16 information related to NIL deals such as contract terms and
17 trustworthy service providers; therefore be it
18 RESOLVED, That the Senate of the Commonwealth of Pennsylvania
19 urge the Congress of the United States, along with the NCAA, to
1 pursue legislative remedies that would help provide uniformity
2 of NIL policy across the states; and be it further
3 RESOLVED, That the Senate encourage the Congress, along with
4 the NCAA, to establish national guidelines for the NIL
5 agreements and a more transparent environment; and be it further
6 RESOLVED, That the Senate encourage the Congress to support
7 uniformity, fairness, oversight and most importantly, protection
8 of our college student athletes; and be it further
9 RESOLVED, That copies of this resolution be transmitted to
10 all of the following:
11 (1) The President pro tempore of the United States
12 Senate.
13 (2) The Speaker of the United States House of
14 Representatives.
15 (3) Each member of Congress from Pennsylvania.
16 (4) The President of the NCAA.
