AN ACT
1 Amending Title 51 (Military Affairs) of the Pennsylvania
2 Consolidated Statutes, in Pennsylvania National Guard,
3 establishing the TRICARE Premium Reimbursement Program.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Title 51 of the Pennsylvania Consolidated
7 Statutes is amended by adding a section to read:
8 § 3106. TRICARE Premium Reimbursement Program.
9 (a) Establishment of program.--The TRICARE Premium
10 Reimbursement Program is established within the department.
11 (b) Grants.--The department may award grants under the
12 program to an eligible recipient for any of the following:
13 (1) A premium paid for individual coverage through the
14 TRICARE Reserve Select program.
15 (2) A premium paid for any member of the immediate
16 family of the eligible recipient covered under the TRICARE
17 Reserve Select program.
18 (3) A premium paid for individual coverage under the
 1 TRICARE dental program.
2 (4) A premium paid for any member of the immediate
3 family of the eligible recipient receiving dental benefits
4 under the TRICARE dental program.
5 (c) Application.--Before the department may award a grant
6 under the program, an eligible recipient must complete a grant
7 application, which includes the following information:
8 (1) The name, address, telephone number, email address
9 and other contact information of the eligible recipient.
10 (2) The name and relationship of any member of the
11 immediate family of the eligible recipient, as applicable,
12 for whom reimbursement of any premium is sought.
13 (3) A statement that the eligible recipient meets the
14 requirements for reimbursement under the program.
15 (4) Proof of payment of any premium specified under
16 subsection (b).
17 (d) Posting of information.--Information regarding the
18 program, including the application form specified under
19 subsection (c), shall be posted on the publicly accessible
20 Internet website of the department.
21 (e) Rules and regulations.--The department shall adopt any
22 rule or regulation necessary to implement and administer the
23 program.
24 (f) Definitions.--As used in this section, the following
25 words and phrases shall have the meanings given to them in this
26 subsection unless the context clearly indicates otherwise:
27 "Eligible recipient." An individual who is:
28 (1) eligible for TRICARE Reserve Select coverage; and
29 (2) a member of the Pennsylvania National Guard.
30 "Immediate family." An individual specified in 10 U.S.C. §

 1 1072(2)(A), (D) or (I) (relating to definitions).
2 "Program." The TRICARE Premium Reimbursement Program
3 established under subsection (a).
4 "TRICARE dental program." The program established in 10
5 U.S.C. § 1076a (relating to TRICARE dental program).
6 "TRICARE Reserve Select." As defined in 10 U.S.C. § 1076d(f)
7 (2) (relating to TRICARE program: TRICARE Reserve Select
8 coverage for members of the Selected Reserve).
9 "TRICARE Reserve Select program." The program established in
10 10 U.S.C. § 1076d.
11 Section 2. This act shall take effect July 25, 2024.
