AN ACT
1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2 Consolidated Statutes, in minors, providing for curfew.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Title 18 of the Pennsylvania Consolidated
6 Statutes is amended by adding a section to read:
7 § 6323. Curfew.
8 (a) Offense defined.--Notwithstanding any other provision of
9 law and except as provided in subsection (b), a minor is guilty
10 of a summary offense if the minor remains in a public place in a
11 municipality during the hours of a curfew established by law or
12 ordinance in the municipality.
13 (b) Affirmative defense.--It is an affirmative defense to a
14 prosecution for an offense under subsection (a) that the minor
15 was:
16 (1) accompanied by the minor's parent or guardian or by
17 another adult;
 1 (2) traveling by motor vehicle, train, bus or other mode
2 of transportation engaged in interstate travel;
3 (3) engaged in an employment activity or traveling home
4 from an employment activity, without any detour or stop;
5 (4) involved in an emergency; or
6 (5) in attendance at, or traveling home from, an
7 official school activity, religious activity or other
8 recreational activity sponsored by the Commonwealth, a civic
9 organization or other similar entity.
10 (c) Definitions.--As used in this section, the following
11 words and phrases shall have the meanings given to them in this
12 subsection unless the context clearly indicates otherwise:
13 "Adult." An individual who is 18 years of age or older.
14 "Minor." An individual who is under 18 years of age.
15 "Municipality." A county, city, borough, incorporated town
16 or township.
17 Section 2. This act shall take effect in 60 days.
