AN ACT
1 Authorizing the State Armory Board to enter into such agreements
2 as may be necessary to exchange with a branch of the United
3 States Armed Forces the right of occupancy in, use of and
4 obligations belonging to certain proprieties owned, managed
5 or occupied by either the State Armory Board or a branch of
6 the United States Armed Forces.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. Definitions.
10 The following words and phrases when used in this act shall
11 have the meanings given to them in this section unless the
12 context clearly indicates otherwise:
13 "State Armory Board." The State Armory Board established
14 under 51 Pa.C.S. Ch. 15 (relating to State Armory Board).
15 "United States Army Reserve." The reserve component of the
16 United State Army, exclusive of the various National Guards,
17 established under 10 U.S.C. Subt. E (relating to reserve
18 components).
19 Section 2. Authorization.
20 The State Armory Board is hereby authorized to enter into
1 such agreements as may be necessary to exchange with the United
2 States Army Reserve the right of occupancy in, use of and
3 obligations belonging to, the properties described in section 3
4 under such terms and conditions as they may determine, subject
5 to the conditions specified in section 4.
6 Section 3. Property description.
7 (a) Johnstown Walters Avenue Readiness Center.--The
8 Johnstown Walters Avenue Readiness Center consists of
9 approximately 15.0 acres of land and improvements located at 656
10 Walters Avenue, Johnstown, Pennsylvania (Tax Parcel No. 50-05-
11 123.1). The Readiness Center was used by the Pennsylvania
12 National Guard to serve and support its mission. The Readiness
13 Center is owned by the Commonwealth of Pennsylvania and is
14 maintained, managed and regulated by the State Armory Board.
15 (b) Building #228 of the Johnstown-Cambria County Airport.--
16 Building #228 is a hangar facility and surrounding
17 infrastructure situated on land owned by the Johnstown-Cambria
18 County Airport Authority. The Johnstown-Cambria County Airport
19 Authority leases Building #228 to the United States Army
20 Reserve. The United States Army Reserve currently uses Building
21 #228 to serve and support its mission.
22 Section 4. Conditions.
23 (a) Funds required.--Prior to the execution of such
24 agreements that may be necessary to effectuate the exchange of
25 rights and obligations authorized under section 2, the State
26 Armory Board must establish that the Department of Military and
27 Veterans Affairs has funds necessary to implement and to support
28 the terms of the agreements, including terms that allocate
29 obligations for maintenance and renovations.
30 (b) Terms and conditions.--The terms and conditions of the

1 exchange authorized under section 2 shall be determined by the
2 State Armory Board and the United States Army Reserve. All terms
3 and conditions must comply with Federal and State statutes and
4 governing regulations. However, notwithstanding the provisions
5 of 51 Pa.C.S. ยง 1509(a) (relating to rental or lease of armories
6 and of buildings or structures at Fort Indiantown Gap) or any
7 other provision of law or regulation that prescribes time
8 periods for leases or other agreements, the State Armory Board
9 may execute a lease or other agreement for a term of not less
10 than 25 years.
11 Section 5. Effective date.
12 This act shall take effect immediately.
