AN ACT
1 Amending the act of April 9, 1929 (P.L.343, No.176), entitled
2 "An act relating to the finances of the State government;
3 providing for cancer control, prevention and research, for
4 ambulatory surgical center data collection, for the Joint
5 Underwriting Association, for entertainment business
6 financial management firms, for private dam financial
7 assurance and for reinstatement of item vetoes; providing for
8 the settlement, assessment, collection, and lien of taxes,
9 bonus, and all other accounts due the Commonwealth, the
10 collection and recovery of fees and other money or property
11 due or belonging to the Commonwealth, or any agency thereof,
12 including escheated property and the proceeds of its sale,
13 the custody and disbursement or other disposition of funds
14 and securities belonging to or in the possession of the
15 Commonwealth, and the settlement of claims against the
16 Commonwealth, the resettlement of accounts and appeals to the
17 courts, refunds of moneys erroneously paid to the
18 Commonwealth, auditing the accounts of the Commonwealth and
19 all agencies thereof, of all public officers collecting
20 moneys payable to the Commonwealth, or any agency thereof,
21 and all receipts of appropriations from the Commonwealth,
22 authorizing the Commonwealth to issue tax anticipation notes
23 to defray current expenses, implementing the provisions of
24 section 7(a) of Article VIII of the Constitution of
25 Pennsylvania authorizing and restricting the incurring of
26 certain debt and imposing penalties; affecting every
27 department, board, commission, and officer of the State
28 government, every political subdivision of the State, and
29 certain officers of such subdivisions, every person,
30 association, and corporation required to pay, assess, or
31 collect taxes, or to make returns or reports under the laws
32 imposing taxes for State purposes, or to pay license fees or
33 other moneys to the Commonwealth, or any agency thereof,
34 every State depository and every debtor or creditor of the
35 Commonwealth," in general budget implementation, further
1 providing for Department of General Services.
2 The General Assembly of the Commonwealth of Pennsylvania
3 hereby enacts as follows:
4 Section 1. Section 1724-E of the act of April 9, 1929
5 (P.L.343, No.176), known as The Fiscal Code, is amended by
6 adding a subsection to read:
7 Section 1724-E. Department of General Services.

9 (d) Quitclaim and release of conditions affecting property
10 in the City and County of Philadelphia.--
11 (1) The Department of General Services, with the
12 approval of the Governor, is hereby authorized on behalf of
13 the Commonwealth of Pennsylvania to quitclaim and release to
14 Programs Employing People, Inc., successor to Programs for
15 Exceptional People, for a consideration of $1, any right,
16 title or interest it may have with respect to certain
17 conditions contained in the prior deed from the Commonwealth
18 of Pennsylvania to Programs for Exceptional People and Its
19 Successor, Programs Employing People, Inc., dated August 31,
20 1995, and recorded in the Department of Records of the City
21 of Philadelphia at Deed Book 1093 Page 78, which conditions
22 were required to be included in such deed by Section 3 of the
23 Act of July 1, 1994, P.L. 387, No. 60.
24 (2) The conditions to be released pursuant to paragraph
25 (1) are as follows:
26 UNDER AND SUBJECT to the condition that any income or
27 proceeds derived from the building conveyed hereto shall
28 be utilized for the expansion and/or enhancement of the
29 Community Mental Retardation Services. Utilization of
30 said funds shall be determined by the Regional Program

1 Manager of the Department of Public Welfare, Office of
2 Mental Retardation Administrator and the Philadelphia
3 County Mental Retardation Administrator. Additionally,
4 the Secretary of Public Welfare shall give written
5 approval of the utilization of the proceeds.
6 ALSO UNDER AND SUBJECT to the condition that the
7 selling or transferring of the above property requires
8 the prior written approval of the Secretaries of General
9 Services and Public Welfare, their assigns or successors
10 in function.
11 ALSO UNDER AND SUBJECT to the condition that no sale
12 or other transfer of the above property shall be
13 permitted earlier than one year following the conveyance
14 of the same property by the Department of General
15 Services.
16 (3) The property affected by the conditions referenced
17 in paragraph (1) is described as follows:
18 All that certain lot and building known as 1200-2-4-
19 6-8 South Broad Street, southwest corner of Federal
20 Street through to South Carlisle Street with dimensions
21 of 125 feet on South Broad Street by 178 feet 2 5/8
22 inches on Federal Street by 133 feet 8 inches on South
23 Carlisle Street located in the City of Philadelphia,
24 Philadelphia County.
25 Containing 23,015 square feet.
26 (4) The quitclaim deed and any other legal instruments
27 necessary to effectuate the quitclaim and release of any
28 right, title or interest the Commonwealth may have with
29 respect to the conditions referenced in paragraph (1) shall
30 be executed by the Secretary of General Services in the name

1 of the Commonwealth of Pennsylvania.
2 (5) Any costs and fees incidental to the quitclaim and
3 release hereby authorized shall be borne by Programs
4 Employing People, Inc.
5 Section 2. This act shall take effect immediately.
