HOUSE CONCURRENT REGULATORY REVIEW RESOLUTION
1 Disapproving the Department of State, Bureau of Professional and
2 Occupational Affairs regulations on Consideration of Criminal
3 Convictions.
4 WHEREAS, The Bureau of Professional and Occupational Affairs
5 submitted a notice of proposed rulemaking related to 49 Pa. Code
6 Ch. 43b (relating to Commissioner of Professional and
7 Occupational Affairs) to the Independent Regulatory Review
8 Commission on November 4, 2022; and
9 WHEREAS, The Bureau of Professional and Occupational Affairs
10 published the proposed regulations related to 49 Pa. Code Ch.
11 43b in the Pennsylvania Bulletin on November 19, 2022; and
12 WHEREAS, The Independent Regulatory Review Commission voted
13 to disapprove the final-form regulations related to 49 Pa. Code
14 Ch. 43b on April 18, 2024; and
15 WHEREAS, The Bureau of Professional and Occupational Affairs
16 submitted revised final-form regulations related to 49 Pa. Code
17 Ch. 43b to the Independent Regulatory Review Commission on June
18 3, 2024; and
19 WHEREAS, In a letter dated June 20, 2024, the Independent
1 Regulatory Review Commission notified the Professional Licensure
2 Committee of the House of Representatives that the Independent
3 Regulatory Review Commission adopted an order approving the
4 regulations; and
5 WHEREAS, The Professional Licensure Committee of the House of
6 Representatives is reporting this resolution under section 7(d)
7 of the Regulatory Review Act for action by the House of
8 Representatives, which shall have 30 calendar days or 10
9 legislative days, whichever is longer, from the date on which
10 the concurrent resolution has been reported to adopt the
11 concurrent resolution; and
12 WHEREAS, The Senate shall have 30 calendar days or 10
13 legislative days, whichever is longer, from the date on which
14 the concurrent resolution has been adopted by the House of
15 Representatives to adopt the concurrent resolution; therefore be
16 it
17 RESOLVED (the Senate concurring), That the General Assembly
18 disapprove the Bureau of Professional and Occupational Affairs
19 regulations on Consideration of Criminal Convictions; and be it
20 further
21 RESOLVED, That, in accordance with section 7(d) of the
22 Regulatory Review Act, this resolution constitute a bar to
23 promulgation of the regulations.
