I will soon be re-introducing legislation to expand the types of vehicles eligible for a refund from the liquid fuels tax to include ready-mix concrete mixers utilizing a power takeoff unit. Pennsylvania already provides a liquid fuels tax refund for agricultural and limestone vehicles that have a power takeoff unit. Similarly, ready-mix concrete trucks use power takeoff units to power both the engine of the vehicle and the mixer. This legislation passed the House with strong bi-partisan support in a previous session.
A power takeoff unit allows additional equipment that is added to a vehicle and the vehicle itself to use fuel from the same fuel tank to operate. The liquid fuels tax is currently levied upon all aviation gasoline, jet fuel, motor gasoline, gasohol, undyed diesel, and undyed kerosene regardless of use.
My legislation will amend the Vehicle Code to expand the liquid fuels tax refund to also include ready-mix concrete truck power takeoff vehicles. An eligible person will be reimbursed for up to 30% of the liquid fuels tax for the fuel used by the power takeoff unit, with the option of a greater refund upon receipt of documentation by and approval of the Board of Finance and Revenue. Each claim made to the Board of Finance and Revenue must be for a minimum of 100 gallons of liquid fuel, and filed on a quarterly basis, within 60 days following the end of a quarter which a claim is made.
