AN ACT
1 Amending the act of April 9, 1929 (P.L.177, No.175), entitled
2 "An act providing for and reorganizing the conduct of the
3 executive and administrative work of the Commonwealth by the
4 Executive Department thereof and the administrative
5 departments, boards, commissions, and officers thereof,
6 including the boards of trustees of State Normal Schools, or
7 Teachers Colleges; abolishing, creating, reorganizing or
8 authorizing the reorganization of certain administrative
9 departments, boards, and commissions; defining the powers and
10 duties of the Governor and other executive and administrative
11 officers, and of the several administrative departments,
12 boards, commissions, and officers; fixing the salaries of the
13 Governor, Lieutenant Governor, and certain other executive
14 and administrative officers; providing for the appointment of
15 certain administrative officers, and of all deputies and
16 other assistants and employes in certain departments, boards,
17 and commissions; providing for judicial administration; and
18 prescribing the manner in which the number and compensation
19 of the deputies and all other assistants and employes of
20 certain departments, boards and commissions shall be
21 determined," in powers and duties of the Department of Labor
22 and Industry, its departmental administrative and advisory
23 boards and departmental administrative officers, further
24 providing for Elevator Safety Board.
25 The General Assembly of the Commonwealth of Pennsylvania
26 hereby enacts as follows:
27 Section 1. Section 2214.1(f) of the act of April 9, 1929
28 (P.L.177, No.175), known as The Administrative Code of 1929, is
1 amended to read:
2 Section 2214.1. Elevator Safety Board.--* * *
3 (f) (1) The board shall recommend regulations to the
4 Secretary of Labor and Industry relating to construction,
5 maintenance and inspection of elevators and safe operation of
6 elevators. The board may consult with engineering authorities
7 and other appropriate organizations regarding the application of
8 elevator industry codes and standards.
9 (2) The Secretary of Labor and Industry shall review any
10 recommendations for regulations submitted by the board and, if
11 the secretary approves the recommendations, shall promulgate
12 regulations consistent with the recommendations.
13 (3) The board may grant exceptions and variances from the
14 requirements of applicable codes and standards or regulations if
15 the changes would not jeopardize the safety and welfare of the
16 general public or individuals employed in the elevator industry.
17 The Department of Labor and Industry shall accept applications
18 for all exceptions and variances and shall make recommendations
19 on the applications to the board.
20 (4) The board may hold hearings and hear appeals on matters
21 relating to this section in accordance with regulations and
22 procedures established by the board in consultation with the
23 Department of Labor and Industry.
24 (5) (i) Commencing July 1, 2025, the applicable elevator
25 code for the Commonwealth shall be the ASME A17.1-2016. The
26 board may recommend modifications to ASME A17.1-2016 prior to
27 the code taking effect. Any recommended modification shall be
28 made to the Department of Labor and Industry no later than
29 December 31, 2024. THE DEPARTMENT OF LABOR AND INDUSTRY SHALL <--
30 CONSIDER ANY RECOMMENDED MODIFICATION MADE BY THE BOARD AND ANY

1 OTHER MODIFICATIONS THE DEPARTMENT OF LABOR AND INDUSTRY MAY
2 DEEM NECESSARY. The Department of Labor and Industry shall
3 transmit notice to the Legislative Reference Bureau of the code
4 along with the modifications by the board INCORPORATED BY THE <--
5 DEPARTMENT OF LABOR AND INDUSTRY for publication in the next
6 available issue of the Pennsylvania Bulletin no later than March
7 31, 2025.
8 (ii) For the purposes of this paragraph, the term "ASME"
9 shall mean the American Society of Mechanical Engineers.
10 Section 2. This act shall take effect immediately.
