AN ACT
1 Amending Title 53 (Municipalities Generally) of the Pennsylvania
2 Consolidated Statutes, in employees, providing for mandatory
3 firearms training for certain law enforcement agencies.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Title 53 of the Pennsylvania Consolidated
7 Statutes is amended by adding a section to read:
8 ยง 2173. Mandatory firearms training for certain law enforcement
9 agencies.
10 (a) General rule.--An officer in a law enforcement agency
11 located in a county of the second class A with a population
12 between 565,000 and 600,000 according to the 2020 Federal
13 decennial census shall undergo and complete mandatory in-service
14 firearms training courses conducted by a certified law
15 enforcement firearms instructor at least four times each year.
16 (b) Documentation.--
17 (1) A certified law enforcement firearms instructor and
18 a law enforcement agency's chief officer shall be responsible
19 for producing and maintaining documentation of any in-service
1 firearms training courses an officer completes, including the
2 number of rounds fired, the officer's scores and the firearms
3 used in training.
4 (2) Documentation issued under this section shall be
5 documented in the commission's Training and Certification
6 System within 30 days of the end of each calendar year,
7 including an officer's primary duty weapon qualification to
8 maintain certification as an officer.
9 (c) Penalty.--An officer who fails to complete the training
10 requirements under this section shall be placed on
11 administrative leave until the requirements have been met.
12 (d) Definitions.--As used in this section, the following
13 words and phrases shall have the meanings given to them in this
14 subsection unless the context clearly indicates otherwise:
15 "Certified law enforcement firearms instructor." A firearms
16 instructor authorized by the commission to conduct firearms
17 training to a police officer within this Commonwealth.
18 "Law enforcement agency." A public agency of a municipality
19 or county having general police powers and charged with making
20 arrests in connection with the enforcement of criminal or
21 traffic laws.
22 "Officer." A police officer employed by a law enforcement
23 agency.
24 Section 2. This act shall take effect immediately.
