A RESOLUTION
1 Directing the Pennsylvania Department of Health to integrate
2 Application Programming Interface (API) technology as
3 required under section 701(c.1) of the act of April 17, 2016
4 (P.L.84, No.16), known as the Medical Marijuana Act, to
5 enhance data interoperability and streamline data
6 communication within the Medical Marijuana Program and ensure
7 that all relevant measures are taken to achieve the intended
8 goals of the act.
9 WHEREAS, On June 30, 2021, Governor Wolf signed House Bill
10 1024 into law as Act 44 of 2021; and
11 WHEREAS, Act 44 contained sustainable updates to the act of
12 April 17, 2016 (P.L.84, No.16), known as the Medical Marijuana
13 Act, including the use of Application Programming Interface
14 (API) for enhanced interoperability and data communication
15 between the Department of Health's current seed-to-sale vendor
16 and medical marijuana organizations; and
17 WHEREAS, The Department of Health was tasked with the
18 implementation of Act 44, including the full integration of API;
19 and
20 WHEREAS, As of the writing of this resolution, seven approved
21 vendors do not have access to two-way API despite the
1 requirements of Act 44; and
2 WHEREAS, Medical marijuana organizations and related
3 entities, including approved testing laboratories, must manually
4 enter sales and testing data in the absence of API; and
5 WHEREAS, The current seed-to-sale vendor has been
6 experiencing chronic outages that have required dispensaries to
7 turn away patients and products to be destroyed; and
8 WHEREAS, If API was fully integrated, dispensaries could
9 remain open and serve customers; therefore be it
10 RESOLVED, That the House of Representatives direct the
11 Department of Health to integrate API technology as required
12 under section 701(c.1) of the act of April 17, 2016 (P.L.84,
13 No.16), known as the Medical Marijuana Act, to enhance data
14 interoperability and streamline data communication within the
15 Medical Marijuana Program and ensure that all relevant measures
16 are taken to achieve the intended goals of the act; and be it
17 further
18 RESOLVED, That the House of Representatives direct the
19 Department of Health to prepare a written review of the contract
20 with the department's current seed-to-sale tracking vendor,
21 which the department shall submit to the House of
22 Representatives within 30 days.
