AN ACT
1 Amending the act of April 9, 1929 (P.L.177, No.175), entitled
2 "An act providing for and reorganizing the conduct of the
3 executive and administrative work of the Commonwealth by the
4 Executive Department thereof and the administrative
5 departments, boards, commissions, and officers thereof,
6 including the boards of trustees of State Normal Schools, or
7 Teachers Colleges; abolishing, creating, reorganizing or
8 authorizing the reorganization of certain administrative
9 departments, boards, and commissions; defining the powers and
10 duties of the Governor and other executive and administrative
11 officers, and of the several administrative departments,
12 boards, commissions, and officers; fixing the salaries of the
13 Governor, Lieutenant Governor, and certain other executive
14 and administrative officers; providing for the appointment of
15 certain administrative officers, and of all deputies and
16 other assistants and employes in certain departments, boards,
17 and commissions; providing for judicial administration; and
18 prescribing the manner in which the number and compensation
19 of the deputies and all other assistants and employes of
20 certain departments, boards and commissions shall be
21 determined," in organization of departmental administrative
22 boards and commissions and of advisory boards and
23 commissions, further providing for the State Geospatial
24 Coordinating Board.
25 The General Assembly of the Commonwealth of Pennsylvania
26 hereby enacts as follows:
27 Section 1. Section 432.1(a), (b)(1), (c)(5), (d), (e), (f),
28 (f.1), (g), (i) and (j) of the act of April 9, 1929 (P.L.177,
29 No.175), known as The Administrative Code of 1929, are amended
1 and the section is amended by adding subsections to read:
2 Section 432.1. State Geospatial Coordinating Board.--(a)
3 There is established a State Geospatial Coordinating Board
4 [within the Governor's Office of Administration. The board is
5 established] to provide advice and recommendations to the
6 Governor and the citizens of this Commonwealth on geospatial
7 issues and provide uniform data standards, coordination and
8 efficiency in geospatial policy and technology issues among
9 Federal, State and local government agencies, academic
10 institutions and the private sector.
11 (b) (1) The State Geospatial Coordinating Board shall
12 consist of the following members:
13 (i) The Secretary of Administration or a designee.
14 (ii) The Secretary of Environmental Protection or a
15 designee.
16 (iii) The Secretary of Conservation and Natural Resources or
17 a designee.
18 (iv) The Director of the Pennsylvania Emergency Management
19 Agency, or its successor agency, or a designee.
20 (v) The Secretary of Transportation or a designee.
21 (vi) The Secretary of General Services or a designee.
22 (vi.1) The Secretary of Agriculture or a designee.
23 (vi.2) The Secretary of Community and Economic Development
24 or a designee.
25 (vi.3) The Secretary of the Commonwealth or a designee.
26 (vii) Three members appointed by the President pro tempore
27 of the Senate in consultation with the Majority Leader and
28 Minority Leader of the Senate. One member shall be a
29 representative of a municipal authority. Two members shall be
30 local government officials or employees.

1 (viii) Three members appointed by the Speaker of the House
2 of Representatives in consultation with the Majority Leader and
3 Minority Leader of the House of Representatives. One member
4 shall be a local government official or employe representing an
5 urban community. One member shall be an employe of a county
6 emergency management agency. One member shall be an individual
7 with expertise in geospatial technology.
8 (ix) Three members appointed by the Governor. One member
9 shall be a county commissioner. One member shall be a member of
10 the Pennsylvania Society of Land Surveyors. One member shall be
11 an individual with expertise in data development and sharing.
12 (x) One member designated by the County Geographic
13 Information Systems Professionals Association of Pennsylvania.
14 (xi) One member designated by [the Pennsylvania Mapping and
15 Geographic Information Consortium] Keystone GIS.
16 (xii) One member designated by the County Commissioners
17 Association of Pennsylvania.
18 [(xiii) One member designated by the Pennsylvania Chapter of
19 the Management Association for Private Photogrammetric
20 Surveyors.]

22 (c) The board shall also include the following nonvoting ex
23 officio members or their designees, who shall have all the
24 rights of other members, except for voting:

26 [(5) One member designated by the Pennsylvania Municipal
27 Authorities Association.]

29 (d) The terms of office of members representing State
30 agencies shall coincide with the term of the Governor, except

1 that the representatives shall continue to serve on the board
2 until their successors are appointed. In case of a vacancy, the
3 Governor shall make an appointment for the unexpired portion of
4 the term. An organizational designee shall serve a term of three
5 years. In the case of a vacancy, the appropriate organization
6 shall provide a designee for the unexpired portion of the term.
7 The replacement council member shall serve until an alternate
8 designee is duly appointed by the appropriate organization for
9 the following term.
10 (e) The Governor or a designee shall designate the
11 chairperson and vice-chairperson of the board from among the
12 members of the board, other than the ex officio members. The
13 board shall meet not less than four times yearly. Additional
14 meetings shall be at the discretion of the chairperson. [Ten]
15 Eleven members of the board shall constitute a quorum.
16 (f) The members of the board shall serve without
17 compensation. [The board may, with the approval of the Governor,
18 appoint and fix the compensation of an executive director who
19 shall be technically qualified for the duties of the office and
20 who shall act as secretary of the board and conduct the work of
21 the board under its supervision.]
22 (f.1) The board may, with the approval of the Governor,
23 appoint an executive director who shall serve at the pleasure of
24 the board. The selection and removal of the executive director
25 shall be made by a [simple] majority of the voting members of
26 the board that constitute a quorum. Compensation for the
27 executive director shall be set by a vote of a majority of the
28 board members identified in subsection (b)(1)(i), (ii), (iii),
29 (iv), (v), (vi) [and], (vi.1), (vi.2) and (vi.3), subject to the
30 approval of the Executive Board. Funding for the executive

1 director's compensation shall be evenly apportioned amongst all
2 of the Commonwealth agencies represented by members in
3 subsection (b)(1)(i), (ii), (iii), (iv), (v), (vi) [and],
4 (vi.1), (vi.2) and (vi.3) and administered by the Governor's
5 Budget Office. The executive director shall be qualified for the
6 duties of the position, as determined by the board, and shall
7 conduct the work of the board under the board's direction and
8 supervision and act as the secretary of the board. No current
9 member of the board may serve as the executive director. The
10 executive director's appointment shall not continue beyond the
11 expiration of this section. The executive director shall be
12 subject to the same policies and procedures as employes of [the
13 Office of Administration.] administrative departments. THE DAY- <--
14 TO-DAY WORK OF THE EXECUTIVE DIRECTOR SHALL BE AT THE DIRECTION
15 AND SUPERVISION OF THE BOARD. FOR ADMINISTRATIVE PURPOSES, THE
16 EXECUTIVE DIRECTOR SHALL REPORT TO THE SECRETARY OF
17 ADMINISTRATION.
18 [(g) From funds appropriated for the purposes of this
19 subsection or to the Office of Administration, the board may
20 employ and fix the compensation of such experts, stenographers
21 and assistants as necessary to carry out the work on the board.
22 The board shall make a diligent effort to enlist voluntary
23 assistance as may be available from citizens, research
24 organizations and other agencies in this Commonwealth or
25 elsewhere, generally recognized as qualified to aid the board.]
26 (g.1) The Office of Administration shall make available
27 facilities, administrative support and other assistance to the
28 board, except that the compensation of the personnel providing
29 the administrative support or assistance to the board shall be
30 made from funds that are apportioned to the Office of

1 Administration for this purpose, or as evenly apportioned
2 amongst each of the Commonwealth agencies represented by members
3 under subsection (b)(1)(i), (ii), (iii), (iv), (v), (vi),
4 (vi.1), (vi.2) and (vi.3) and administered by the Office of the
5 Budget. The board shall make a diligent effort to enlist
6 voluntary assistance as may be available from citizens, research
7 organizations and other agencies, generally recognized as
8 qualified to aid the board.
9 (g.2) The board may contract with vendors as needed to carry
10 out the work of the board, except that the payment of the
11 vendors shall be made from funds that are apportioned to the
12 Office of Administration for this purpose or as evenly
13 apportioned amongst each of the Commonwealth agencies
14 represented by members under subsection (b)(1)(i), (ii), (iii),
15 (iv), (v), (vi), (vi.1), (vi.2) and (vi.3) and administered by
16 the Office of the Budget.

18 [(i) The Office of Administration shall provide
19 administrative assistance to the board and may provide other
20 assistance to the board upon recommendation of the chairperson,
21 if sufficient Commonwealth resources exist.]
22 (j) This section shall expire [June 30, 2024] July 31, 2028.
23 Section 2. This act shall take effect immediately.
