AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, IN RULES OF THE ROAD IN GENERAL, FURTHER PROVIDING <--
3 FOR PROHIBITING USE OF HEARING IMPAIRMENT DEVICES AND FOR
4 ADDITIONAL PARKING REGULATIONS; in inspection of vehicles,
5 further providing for inspection of motorcycles.; AND, IN <--
6 MOTORCYCLES, FURTHER PROVIDING FOR MOTORCYCLE SAFETY
7 EDUCATION PROGRAM.
8 The General Assembly of the Commonwealth of Pennsylvania
9 hereby enacts as follows:
10 Section 1. Section 4708 of Title 75 of the Pennsylvania <--
11 Consolidated Statutes is amended to read:
12 SECTION 1. SECTION 3314(B) OF TITLE 75 OF THE PENNSYLVANIA <--
13 CONSOLIDATED STATUTES IS AMENDED TO READ:
14 § 3314. PROHIBITING USE OF HEARING IMPAIRMENT DEVICES.

16 (B) EXCEPTION.--THIS SECTION DOES NOT PROHIBIT THE USE OF
17 HEARING AIDS OR OTHER DEVICES FOR IMPROVING THE HEARING OF THE
18 DRIVER, NOR DOES IT PROHIBIT THE USE OF A HEADSET IN CONJUNCTION
19 WITH A CELLULAR TELEPHONE THAT ONLY PROVIDES SOUND THROUGH ONE
1 EAR AND ALLOWS SURROUNDING SOUNDS TO BE HEARD WITH THE OTHER
2 EAR, NOR DOES IT PROHIBIT THE USE OF COMMUNICATION EQUIPMENT BY
3 THE DRIVER OF AN EMERGENCY VEHICLE OR BY MOTORCYCLE OPERATORS
4 COMPLYING WITH SECTION 3525 (RELATING TO PROTECTIVE EQUIPMENT
5 FOR MOTORCYCLE RIDERS)[.], NOR DOES IT PROHIBIT MOTORCYCLE
6 OPERATORS COMPLYING WITH SECTION 3525 FROM WEARING OR USING ONE
7 OR MORE HEADPHONES OR EARPHONES OR PROTECTIVE HEADGEAR WITH THE
8 SAME CAPABILITIES.
9 SECTION 2. SECTION 3354(D)(2.1) AND (F) OF TITLE 75 ARE
10 AMENDED AND THE SECTION IS AMENDED BY ADDING A SUBSECTION TO
11 READ:
12 § 3354. ADDITIONAL PARKING REGULATIONS.

14 (B.1) PROTECTED PEDESTRIAN PLAZAS AND PEDALCYCLE LANES.--
15 (1) WHEN THERE IS AN ON-STREET PEDESTRIAN PLAZA OR A
16 PEDALCYCLE LANE ADJACENT TO THE RIGHT-HAND CURB OF A TWO-WAY
17 OR ONE-WAY HIGHWAY, A VEHICLE STANDING OR PARKED UPON THE
18 RIGHT-HAND SIDE OF THE TWO-WAY OR ONE-WAY HIGHWAY SHALL BE
19 POSITIONED IN THE DIRECTION OF AUTHORIZED TRAFFIC MOVEMENT
20 WITH THE RIGHT-HAND WHEELS OF THE VEHICLE PARALLEL TO AND
21 WITHIN 12 INCHES OF THE OUTSIDE LINE OF THE BUFFER AREA
22 BETWEEN THE PEDESTRIAN PLAZA OR PEDALCYCLE LANE AND PARKING.
23 (2) WHEN THERE IS AN ON-STREET PEDESTRIAN PLAZA OR A
24 PEDALCYCLE LANE ADJACENT TO THE LEFT-HAND CURB OF A ONE-WAY
25 OR MEDIAN-DIVIDED, TWO-WAY HIGHWAY, A VEHICLE STANDING OR
26 PARKED UPON THE LEFT-HAND SIDE OF THE HIGHWAY SHALL BE
27 POSITIONED IN THE DIRECTION OF AUTHORIZED TRAFFIC MOVEMENT
28 WITH THE LEFT-HAND WHEELS OF THE VEHICLE PARALLEL TO AND
29 WITHIN 12 INCHES OF THE OUTSIDE LINE OF THE BUFFER AREA
30 BETWEEN THE PEDESTRIAN PLAZA OR PEDALCYCLE LANE AND PARKING.

1 (3) NOTHING UNDER THIS SECTION SHALL BE DEEMED TO
2 PREVENT A LOCAL AUTHORITY FROM ENACTING PARKING REGULATIONS
3 UNDER SECTION 6109 (RELATING TO SPECIFIC POWERS OF DEPARTMENT
4 AND LOCAL AUTHORITIES) TO PROVIDE FOR A SPECIAL, ALTERNATIVE
5 OR TEMPORARY CONFIGURATION AND SIGNAGE FOR PARKING ON A
6 HIGHWAY WITH AN ON-STREET PEDESTRIAN PLAZA OR PEDALCYCLE
7 LANE.
8 (4) NOTHING UNDER THIS SECTION SHALL BE DEEMED TO APPLY
9 TO THE STOPPING OR STANDING OF SCHOOL BUSES OR SCHOOL
10 VEHICLES WHEN RECEIVING OR DISCHARGING SCHOOL STUDENTS. A
11 SCHOOL BUS OR SCHOOL VEHICLE MAY STOP OR STAND AS CLOSE AS
12 PRACTICABLE TO THE CURB OR SHOULDER.

14 (D) PERSON WITH A DISABILITY AND DISABLED VETERANS.--
15 * * *
16 (2.1) LOCAL AUTHORITIES MAY LIMIT ACCESS TO A PARKING
17 SPACE RESERVED UNDER PARAGRAPH (2) TO A SPECIFIC VEHICLE,
18 LICENSE PLATE OR OTHER METHOD OF DESIGNATION. UNDER THIS
19 PARAGRAPH, LOCAL AUTHORITIES MAY CHARGE A REASONABLE FEE AND
20 SHALL COMPLY WITH SECTION 6109 [(RELATING TO SPECIFIC POWERS
21 OF DEPARTMENT AND LOCAL AUTHORITIES)] AND THE AMERICANS WITH
22 DISABILITIES ACT OF 1990 (PUBLIC LAW 101-336, 104 STAT. 327).

24 (F) PENALTY.--A PERSON VIOLATING SUBSECTION (A), (B), (B.1)
25 OR (D)(1) IS GUILTY OF A SUMMARY OFFENSE AND SHALL, UPON
26 CONVICTION, BE SENTENCED TO PAY A FINE OF NOT MORE THAN $15. A
27 PERSON VIOLATING SUBSECTION (D)(2) OR (3) OR (E) IS GUILTY OF A
28 SUMMARY OFFENSE AND SHALL, UPON CONVICTION, BE SENTENCED TO PAY
29 A FINE OF NOT LESS THAN $50 NOR MORE THAN $200. IF A PERSON IS
30 CONVICTED UNDER SUBSECTION (D)(2) OR (3) IN THE ABSENCE OF A

1 SIGN STATING THE PENALTY AMOUNT, THE FINE IMPOSED MAY NOT EXCEED
2 $50. A PERSON VIOLATING SUBSECTION (D.1) IS GUILTY OF A SUMMARY
3 OFFENSE AND SHALL, UPON CONVICTION, BE SENTENCED TO PAY A FINE
4 OF NOT LESS THAN $100 NOR MORE THAN $300.

6 SECTION 3. SECTION 4708 OF TITLE 75 IS AMENDED TO READ:
7 § 4708. Inspection of motorcycles.
8 [An annual system of inspections in accordance with section
9 4702 (relating to requirement for periodic inspection of
10 vehicles) shall be established for motorcycles according to the
11 following schedule:
12 (1) Motorcycles whose registrations expire in the months
13 of January and July shall be inspected in the months of May,
14 June or July.
15 (2) Motorcycles whose registrations expire in the months
16 of February and August shall be inspected in the months of
17 June, July or August.
18 (3) Motorcycles whose registrations expire in the months
19 of March and September shall be inspected in the months of
20 July, August or September.
21 (4) Motorcycles whose registrations expire in the months
22 of April and October shall be inspected in the months of
23 August, September or October.
24 (5) Motorcycles whose registrations expire in the months
25 of May and November shall be inspected in the months of
26 March, April or May.
27 (6) Motorcycles whose registrations expire in the months
28 of June and December shall be inspected in the months of
29 April, May or June.] A motorcycle shall be inspected annually
30 and shall receive a safety inspection sticker valid for one

1 year from the expiration of the safety inspection sticker
2 which is about to expire. A safety inspection sticker for a
3 motorcycle may not be issued for more than 15 months from the
4 month of inspection. If a motorcycle does not display a
5 currently valid certificate of inspection, the motorcycle
6 shall receive a safety inspection sticker valid for one year
7 from the month of inspection. <--
8 Section 2. This act shall take effect in 60 days.
9 SECTION 4. SECTION 7911 OF TITLE 75 IS AMENDED BY ADDING A <--
10 SUBSECTION TO READ:
11 § 7911. MOTORCYCLE SAFETY EDUCATION PROGRAM.

13 (C) REFUNDABLE REGISTRATION FEE.--
14 (1) NO FEE SHALL BE CHARGED TO AN INDIVIDUAL WHO
15 REGISTERS FOR AN APPROVED MOTORCYCLE SAFETY COURSE EXCEPT FOR
16 A NOMINAL REGISTRATION FEE AS DETERMINED BY THE DEPARTMENT
17 WHICH SHALL NOT EXCEED $50 AND SHALL BE REFUNDED IF THE
18 INDIVIDUAL ATTENDS THE APPROVED MOTORCYCLE SAFETY COURSE. ANY
19 NOMINAL REGISTRATION FEE NOT REFUNDED UNDER THIS SUBSECTION
20 SHALL BE DEPOSITED INTO THE MOTORCYCLE SAFETY EDUCATION
21 ACCOUNT ESTABLISHED UNDER SECTION 7905 (RELATING TO
22 RESTRICTED RECEIPTS ACCOUNT).
23 (2) WITHIN 18 MONTHS OF THE EFFECTIVE DATE OF THIS
24 SUBSECTION, THE DEPARTMENT SHALL ISSUE A REPORT ANALYZING THE
25 EFFECT OF THE FEE AUTHORIZED UNDER THIS SUBSECTION ON
26 ENROLLMENT IN MOTORCYCLE SAFETY COURSES. THE REPORT SHALL BE
27 ISSUED TO THE CHAIRPERSON AND MINORITY CHAIRPERSON OF THE
28 TRANSPORTATION COMMITTEE OF THE SENATE AND THE CHAIRPERSON
29 AND MINORITY CHAIRPERSON OF THE TRANSPORTATION COMMITTEE OF
30 THE HOUSE OF REPRESENTATIVES AND POSTED ON THE DEPARTMENT'S

1 PUBLICLY ACCESSIBLE INTERNET WEBSITE. THE REPORT SHALL
2 INCLUDE ALL OF THE FOLLOWING:
3 (I) DATA REGARDING THE NUMBER OF INDIVIDUALS WHO
4 COMPLETED A MOTORCYCLE SAFETY COURSE PRIOR TO THE
5 EFFECTIVE DATE OF THIS SUBSECTION.
6 (II) DATA REGARDING THE NUMBER OF INDIVIDUALS WHO
7 ENROLLED IN A MOTORCYCLE SAFETY COURSE PRIOR TO THE
8 EFFECTIVE DATE OF THIS SUBSECTION AND FAILED TO ATTEND
9 THE MOTORCYCLE SAFETY COURSE.
10 (III) DATA REGARDING THE NUMBER OF INDIVIDUALS WHO
11 COMPLETED A MOTORCYCLE SAFETY COURSE AFTER THE EFFECTIVE
12 DATE OF THIS SUBSECTION.
13 (IV) DATA REGARDING THE NUMBER OF INDIVIDUALS WHO
14 ENROLLED IN A MOTORCYCLE SAFETY COURSE AFTER THE
15 EFFECTIVE DATE OF THIS SUBSECTION AND FAILED TO ATTEND
16 THE MOTORCYCLE SAFETY COURSE.
17 (V) THE TOTAL AMOUNT OF FEES REFUNDED UNDER THIS
18 SUBSECTION.
19 (VI) THE TOTAL AMOUNT OF FEES DEPOSITED INTO THE
20 MOTORCYCLE SAFETY EDUCATION ACCOUNT UNDER THIS
21 SUBSECTION.
22 (VII) SUGGESTED STATUTORY CHANGES THAT MAY IMPROVE
23 ENROLLMENT IN MOTORCYCLE SAFETY COURSES.
24 (VIII) ANY OTHER INFORMATION AT THE DISCRETION OF
25 THE DEPARTMENT.
26 SECTION 5. THIS ACT SHALL TAKE EFFECT AS FOLLOWS:
27 (1) THE ADDITION OF 75 PA.C.S. § 7911(C) SHALL TAKE
28 EFFECT IN 42 MONTHS.
29 (2) THIS SECTION SHALL TAKE EFFECT IMMEDIATELY.
30 (3) THE REMAINDER OF THIS ACT SHALL TAKE EFFECT IN 60
