AN ACT
1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2 act relating to the public school system, including certain
3 provisions applicable as well to private and parochial
4 schools; amending, revising, consolidating and changing the
5 laws relating thereto," in terms and courses of study,
6 providing for credit for employment at congregate care
7 facility.
8 The General Assembly of the Commonwealth of Pennsylvania
9 hereby enacts as follows:
10 Section 1. The act of March 10, 1949 (P.L.30, No.14), known
11 as the Public School Code of 1949, is amended by adding a
12 section to read:
13 Section 1507. Credit for Employment at Congregate Care
14 Facility.--(a) A student who is in grade eleven or twelve at a
15 school entity or nonpublic school and who is employed, either on
16 a paid or voluntary basis, at a congregate care facility may
17 earn one elective credit toward graduation for each three <--
18 hundred fifty (350) TWO HUNDRED FIFTY (250) hours worked at the <--
19 congregate care facility, for a maximum of two elective credits
20 toward graduation.
1 (b) The school entity or nonpublic school, in coordination <--
2 with the Department of Education, shall develop an SHALL DEVELOP <--
3 OR MODIFY AN EXISTING application process and form for the
4 student seeking elective credit under this section. The
5 following apply:
6 (1) The application form shall require the following
7 information:
8 (i) The name of the student.
9 (ii) The name, address and telephone number of the
10 congregate care facility at which the student is employed.
11 (iii) The name of any individual supervising the student at
12 the congregate care facility.
13 (iv) The nature of the student's employment at the
14 congregate care facility.
15 (v) The number of hours that the student is employed at the
16 congregate care facility.
17 (2) The school entity or nonpublic school shall establish
18 deadlines for submission of the application and any conditions
19 that the student must meet to obtain any elective credit toward <--
20 graduation, including verification of the number of hours worked
21 at the congregate care facility.
22 (3) Before any elective credit may be awarded to the <--
23 student, the school entity or nonpublic school must approve the
24 student's application and the student must satisfy all the
25 requirements under this section. THE SCHOOL ENTITY OR NONPUBLIC <--
26 SCHOOL MAY NOT AWARD THE ELECTIVE CREDIT TO THE STUDENT UNLESS
27 THE SCHOOL ENTITY OR NONPUBLIC SCHOOL HAS APPROVED THE STUDENT'S
28 APPLICATION AND THE STUDENT HAS SATISFIED ALL THE REQUIREMENTS
29 UNDER THIS SECTION.
30 (c) As used in this section, the following words and phrases

1 shall have the meanings given to them in this subsection unless
2 the context clearly indicates otherwise:
3 "Congregate care facility" shall mean any of the following:
4 (1) A long-term care nursing facility as defined in section
5 802.1 of the act of July 19, 1979 (P.L.130, No.48), known as the
6 "Health Care Facilities Act."
7 (2) A personal care home or an assisted living residence,
8 licensed by the Department of Human Services under the act of
9 June 13, 1967 (P.L.31, No.21), known as the "Human Services
10 Code."
11 "Nonpublic school" shall mean a nonprofit school, other than
12 a public school in this Commonwealth, wherein a resident of this
13 Commonwealth may legally fulfill the compulsory school
14 attendance requirements of this article and which meet the
15 requirements of Title VI of the Civil Rights Act of 1964 (Public
16 Law 88-352, 42 U.S.C. ยง 2000 et seq.).
17 "School entity" shall mean a public school, including a <--
18 SCHOOL DISTRICT, charter school or cyber charter school, <--
19 intermediate unit or area career and technical school operating
20 within this Commonwealth.
21 Section 2. This act shall take effect in 60 days.
