AN ACT
1 Amending Title 25 (Elections) of the Pennsylvania Consolidated
2 Statutes, in voter registration, further providing for
3 application with driver's license application and for
4 preparation and distribution of applications.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Section 1323(a)(1) and (b)(1) and (3) of Title 25
8 of the Pennsylvania Consolidated Statutes are amended to read:
9 § 1323. Application with driver's license application.
10 (a) General rule.--
11 (1) The Department of Transportation shall provide for
12 simultaneous application for voter registration in
13 conjunction with the process under 75 Pa.C.S. § 1510
14 (relating to issuance and content of driver's license). An
15 application under this subsection shall serve as an
16 application to register to vote unless the applicant declines
17 to register to vote under this section or fails to sign the
18 voter registration application. The secretary has the primary
1 responsibility for implementing and enforcing the driver's
2 license voter registration system created under this section.
3 The secretary, in consultation with the Secretary of
4 Transportation, may promulgate regulations for implementing
5 this section.

7 (b) Process.--
8 (1) The Department of Transportation shall provide for
9 an application for voter registration as part of a driver's
10 license application unless the applicant declines to register
11 to vote under this section.

13 (3) The voter registration application portion of the
14 application shall contain all the requirements of an official
15 voter registration application specified in section 1327
16 (relating to preparation and distribution of applications).
17 The voter registration portion of the application:
18 (i) may not require any information that duplicates
19 information required in the driver's license portion of
20 the form, other than a second signature; [and]
21 (ii) may require only the minimum amount of
22 information necessary to prevent duplicate voter
23 registration, to enable the commission to assess the
24 eligibility of the applicant and to administer voter
25 registration and other parts of the election process[.];
26 and
27 (iii) shall inform an applicant that the applicant
28 shall be registered to vote under this section unless the
29 applicant declines to register to vote under this
30 section.

2 Section 2. Section 1327(a)(4)(x) of Title 25 is amended and
3 paragraphs (1) and (4) are amended by adding subparagraphs to
4 read:
5 § 1327. Preparation and distribution of applications.
6 (a) Form.--
7 (1) The secretary shall prescribe the form of an
8 official voter registration application. The official voter
9 registration application shall provide space for the
10 following information about the applicant:

12 (ix) Email address. An official voter registration
13 application shall not be rejected due to the applicant's
14 failure to provide an email address.

16 (4) A voter registration application shall be printed on
17 stock of good quality and shall be of suitable uniform size.
18 Nothing in this part shall prohibit the design and use of an
19 electronic voter registration application which includes the
20 applicant's digitized or electronic signature. The
21 registration application shall contain the following
22 information; however, the information may be provided on a
23 separate form for voter registration made under section 1323
24 or 1325:

26 (v.1) Notice that the commission will notify the
27 individual by nonforwardable mail, or by email, if the
28 registrant provides one, of the status of the
29 registrant's application and that, if the individual was
30 inadvertently registered to vote after declining to

1 register to vote, the department shall correct the error
2 and notify the commission that the individual shall not
3 be considered to have become registered to vote.

5 (x) Notice that, if an individual does register to
6 vote, the office at which the individual submits a voter
7 registration application will remain confidential and
8 will be used for voter registration purposes only. The
9 notices required in this subparagraph shall be [in print]
10 identical to the declaration in subsection (b).

12 Section 3. This act shall take effect January 1, 2025.
