AN ACT
1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2 act relating to the public school system, including certain
3 provisions applicable as well to private and parochial
4 schools; amending, revising, consolidating and changing the
5 laws relating thereto," in preliminary provisions, providing
6 for requiring students to take academic assessments online.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. The act of March 10, 1949 (P.L.30, No.14), known
10 as the Public School Code of 1949, is amended by adding a
11 section to read:
12 Section 134. Requiring Students to Take Academic Assessments
13 Online.--(a) Except as provided under subsection (b), and
14 beginning with the 2024-2025 school year, the Department of
15 Education shall require students to complete the following
16 examinations online:
17 (1) Keystone Exam.
18 (2) PSSA test.
19 (3) Any other examination or academic assessment developed
1 by the Department of Education that is administered to each
2 student throughout this Commonwealth.
3 (b) The following students shall not be required to complete
4 an examination online under subsection (a):
5 (1) A student whose IEP does not allow the student to
6 complete an examination online.
7 (2) A student who is learning English as a second language.
8 (c) Results of an examination taken online under subsection
9 (a) shall be reported to the school district within ten (10)
10 business days.
11 (d) To the extent funding is available, the Department of
12 Education shall establish a grant program to help school
13 entities purchase the necessary technology and Internet
14 connectivity resources to enable the online testing requirements
15 of this section.
16 (e) The State Board of Education shall promulgate or revise
17 regulations, subject to the act of June 25, 1982 (P.L.633,
18 No.181), known as the "Regulatory Review Act," necessary to
19 implement this section.
20 (f) As used in this section, the following words and phrases
21 shall have the meanings given to them in this subsection unless
22 the context clearly indicates otherwise:
23 "IEP." As defined under section 1331.1(e).
24 "School." As defined under section 1401-B.
25 Section 2. This act shall take effect in 60 days.
